The ERA provides a legal backdrop for all relationships between employees, employers, and unions. It aims to promote the concepts of good faith, fair process, and mediation as the first step when employment relationship issues need resolving. If employment relationship issues cannot be resolved by mediation, under the ERA resolution can be sought via the Employment Relations Authority and\/or the Employment Court. <\/p>\n\n
The Act sets out the process for personal grievances, collective bargaining, union memberships, and effective enforcement of employment standards. <\/p>\n\n

The key purpose of the Holidays Act is to promote a work-life balance by setting out the minimum rights and requirements for annual leave, sick leave, and bereavement leave. It also outlines the requirements for payments and days in lieu related to public holidays.<\/p>\n\n
Note, although the Act outlines the minimum requirement, employers may increase the minimum at their discretion. This should be documented in the employee agreement\/contract.<\/p>\n\n

Everyone who works is entitled to be paid for the work they do. The Minimum Wage Act sets out the rates for the three different minimum rates:<\/p>\n\n

This is a major piece of legislation for any employer, particularly in any industry where there is a high risk of injury and\/or illness, such as construction.<\/p>\n\n
The HSWA is focused on the health and safety of everyone in the workplace. It identifies the level of responsibilities for anyone and everyone working, whether in a small or large organisation or self-employed.<\/p>\n\n

The key purpose of this act is to prevent employment discrimination. For example, if someone were to apply for a job, employers are not able to discriminate against the applicant if they are suitably qualified for the work. Sources of discrimination may be age, gender, race, marital status, religious belief, ethnicity, disability etc.<\/p>\n\n

What you need to know about the Acts<\/h3>\n\n
The Acts are generally big documents and full of technical language. As such, they can be difficult to navigate. There is an expectation that employers have some idea on how certain Acts apply to them and their employees.<\/p>\n\n
These Acts also govern how workplaces are managed and can also influence how employers and employees interact. This, in turn, can influence the culture of the workplace.<\/p>\n\n
Knowing in which part of the business the Act is relevant is important so that you can ensure that the right processes are in place. For example, the Human Rights Act generally applies to recruitment of staff and remuneration packages. The ERA applies when offering employment and developing the employment agreement. HSWA applies to the operational side of the business and should be included in policies.<\/p>\n\n
The important thing to remember with legislation and ensuring compliance \u2013 if you are unsure, seek help. Find yourself a good employment lawyer. The initial expense may save you a lot of money in the long run.<\/p>\n\n

What is compliance?<\/h2>\n\n
Compliance can be defined as the action or evidence of complying with a wish or command. In the business world, compliance means taking actions or gathering evidence that demonstrates that the rules, regulations, and any relevant legislation for your industry, has been followed. It may also refer to financial requirements, such as tax obligations.<\/p>\n\n
Non-compliance will leave a business open to a raft of issues that will impact on employees, customers\/clients, and overall business success. How is compliance demonstrated?<\/h3>\n\n
So, how can compliance be demonstrated? For businesses, compliance means having a well thought out plan that includes the right policies and procedures to ensure that they meet compliance requirements in a timely manner. Businesses also need to ensure that they have a good recording and documentation process.<\/p>\n\n
Do you need to have multiple policies documented if you are a small business? If you are planning to employ people, ideally you should have policies in place. That way, your staff will know what is expected of them and what they can expect from you.<\/p>\n\n
The good news is that there are plenty of resources available to help you get started. Some options for support include:<\/p>\n\n

Your local Chamber of Commerce can help with small business advice<\/li>\n\t

Ideally, you will develop some of your own policies and procedures before you employ someone. At the very least you should have some form of job description and employment agreements in place.<\/p>\n\n
Once you have some employees, you can use them to help develop your outstanding policies and procedures. Call on their experience and knowledge that they bring with them. Including them in the development of the documents increases the likelihood of the policies and procedures being used and followed correctly. What policies should I include?<\/h3>\n\n
The type and number of policies and procedures is ultimately up to you. The more guidance that is in place, the less chance of confusion or uncertainty. However, this needs to be balanced \u2013 too many policies and procedures may give the impression of being too restrictive and\/or controlling.<\/p>\n\n
